Hearst Media Services, WARNING NOTICE OF SPECIAL TOWN MEETING OF THE TOWN OF BETHEL, CONNECTICUT The Legal Voters of the Town of Bethel, Connecticut, and those persons entitled to vote therein, are notified to assemble at a Special Town Meeting to be held in the Clifford J. Hurgin Municipal Center General Purpose Room, 1 School Street, Bethel, Connecticut 06801 on Tuesday, September 6, 2016 at 7:00 p.m. for the following purposes, to wit: 1.) To consider and take action upon a recommendation by the Public Utilities Commission and approved by the Board of Selectmen and the Board of Finance, to fund an amount, not to exceed $1,367,075 for the construction of the Hoyt's Hill Pump Station Upgrade, said sum includes the amount of construction of $1,253,905; oversight for engineering and administration in the amount of $48,070; and, a total project contingency of 5% in the amount of $65,100. Said funding shall come from bonding, bond anticipatory notes, temporary borrowing and/or other appropriation as recommended by the Comptroller to be reduced by any available grants obtained by the Town of Bethel and/or the Bethel Public Utilities Commission, if any. Payment for the appropriated sums shall be made by the water account users of the Bethel Public Utilities Commission. Pursuant to Connecticut General Statute § 7-7, the Bethel Board of Selectmen by resolution on August 29, 2016 have removed this Item No. 1, funding for the construction of the Hoyt's Hill Pump Upgrade from a vote by the body of this Special Town Meeting and adjourned this vote to a Town wide machine vote to be held on the date as established by this body of the Special Town Meeting between the hours of twelve o'clock noon (12:00) PM and eight o'clock (8:00) PM unless the body of this Special Town Meeting approves earlier hours for th opening of the Town wide machine vote pursuant to Connecticut General Statute § 7-9b. 2.) To consider and take action upon a recommendation by the Public Utilities Commission and approved by the Board of Selectmen and the Board of Finance, to fund an amount not to exceed $995,867 for the replacement of the Maple Avenue Wells. Said sum includes the amount of construction of $893,467; oversight for engineering and administration in the amount of $87,400; and a total project contingency of $15,000. Said funding shall come from bonding, bond anticipatory notes, temporary borrowing and/or other appropriation as recommended by the Comptroller to be reduced by any available grants obtained by the Town of Bethel and/or the Bethel Public Utilities Commission, if any. Payment for the appropriated sums shall be made by the water account users of the Bethel Public Utilities Commission. 3.) The Press-Enterprise, NOTICE OF PUBLIC HEARING OF INTENTION TO ESTABLISH COMMUNITY FACILITIES DISTRICT NO. 16-2 OF THE CORONA-NORCO UNIFIED SCHOOL DISTRICT AND TO AUTHORIZE THE LEVY OF A SPECIAL TAX NOTICE IS HEREBY GIVEN that the Board of Education of the Corona-Norco Unified School District (hereinafter referred to as the "Board of Education") adopted its 2016-17 Resolution No. 41 (the "Resolution of Intention") on August 2, 2016. Exhibit "B" allows each landowner and resident within each proposed improvement area of CFD No. 16-2 to estimate the maximum amount that may be levied against each parcel. The Press-Enterprise, NOTICE OF PUBLIC HEARING ON INTENTION TO FORM COMMUNITY FACILITIES DISTRICT NO. 2016-74 (MENIFEE TOWN CENTER) OF EASTERN MUNICIPAL WATER DISTRICT TO LEVY SPECIAL TAXES THEREIN AND TO AUTHORIZE BONDED INDEBTEDNESS NOTICE IS HEREBY GIVEN that on July 20, 2016 the Board of Directors (the "Board of Directors") of Eastern Municipal Water District (the "District") adopted its Resolution No. 2016 086 (the "Resolution of Intention"), declaring its intention to form Community Facilities District No. 2016-74 (Menifee Town Center) of Eastern Municipal Water District ("CFD No. 2016-74" or the "District"), and Improvement Areas A through D therein (each an "Improvement Area, and, collectively, the "Improvement Areas"), pursuant to the Mello Roos Community Facilities Act of 1982, as amended (the "Act") and to levy a special tax (the "Special Tax") within each Improvement Area of CFD No. 2016-74 for the purpose of financing certain Improvements and Incidental Expenses. CFD No. 2016-74 and the Improvement Areas therein are proposed to have the boundaries depicted on the map therefor on file with the Secretary of the Board of Directors of Eastern Municipal Water District (the "Board of Directors"). Also on July 20, 2016, the Board of Directors adopted its Resolution No. 2016-087 (the "Resolution of Intention to Incur Indebtedness") declaring its intention to incur bonded indebtedness to be issued by CFD No. 2016-74 on behalf of each of the Improvement Areas in the maximum principal amount of $9,000,000 for Improvement Area A, $6,000,000 for Improvement Area B, $5,000,000 for Improvement Area C, and $9,000,000 for Improvement Area D. Capitalized terms that are not otherwise defined herein shall have the respective meanings ascribed to them in the Resolution of Intention and the exhibits thereto. The proposed improvements (the "Improvements") include (i) the construction, purchase, modification, expansion, improvement and/or rehabilitation of water and sewer facilities including the acquisition of capacity in the sewer system of Eastern Municipal Water District (the "Water District"), both onsite and offsite, and all appurtenances and appurtenant work in connection with the foregoing including the cost of engineering, planning, designing, materials testing, coordination, construction staking, construction management and supervision for such Improvements and any other expense incidental to the construction, acquisition, modification, expansion or rehabilitation of such Improvements, (ii) the construction, purchase, modification, expansion, improvement and/or rehabilitation of school facilities to be owned and operated by the Menifee Union School District including, without limitation, classrooms, multi-purpose, administration and auxiliary space at a school, and interim housing, together with furniture, equipment and technology, needed by the Menifee Union School District in order to mitigate the impact on school facilities of the student population to be generated as a result of the development of the property to be included within CFD No. 2016-74, together with all land or interests in land required for the construction of such school facilities and all land or interests in land required to be provided by the Menifee Union School District as mitigation of environmental impacts associated with the development of such school facilities, and central support and administrative facilities, transportation and special education facilities, including any incidental school administration and transportation center improvements and (iii) the construction, purchase, modification, expansion, improvement and/or rehabilitation of public facilities to be owned and operated by the City of Menifee (the "City"), and all appurtenances and appurtenant work in connection with the foregoing including the cost of engineering, planning, designing, materials testing, coordination, construction staking, construction management and supervision for such Improvements and any other expense incidental to the construction, acquisition, modification, expansion or rehabilitation of such Improvements. The Improvements listed herein are representative of the types of improvements authorized to be financed by CFD No. 2016-74 and the Improvement Areas therein. Detailed scope and limits of specific projects will be determined as appropriate, consistent with the standards of the Water District, the School District and the City. Addition, deletion or modification of descriptions of the Improvements may be made consistent with the requirements of the Board of Directors, the School District, the City, CFD No. 2016-74 and the Act. The Incidental Expenses to be paid from bond proceeds and/or special taxes include: All costs associated with the creation of CFD No. 2016-74 and the Improvement Areas therein, the issuance of the bonds for each Improvement Area, the determination of the amount of special taxes to be levied within each Improvement Area, costs otherwise incurred in order to carry out the authorized purposes of CFD No. 2016-74, including legal fees, fees of consultants, engineering, planning, designing and the annual administration cost of CFD No. 2016-74 and the Improvement Areas therein. The Resolution of Intention specifies the Rate and Method of Apportionment of Special Tax for each Improvement Area within CFD No. 2016-74 (each a "Rate and Method," and, collectively, the "Rates and Methods"). The Resolution of Intention proposes a Maximum Special Tax within Improvement Area A for Developed Property within the property depicted in the boundary map, which shall be the greater of (i) the amount derived by application of the Assigned Special Tax as set forth in the Rate and Method for Improvement Area A or (ii) the amount derived by application of the Backup Special Tax. For example, the Assigned Special Tax for a Single Family Property in Improvement Area A ranges from $1,900 per taxable unit with residential floor area of less than 1,600 square feet to $2,830 per taxable unit with a residential floor area of greater than 3,999 square feet. The Assigned Special Tax on Multifamily Residential Property and Non Residential Property in Improvement Area A is $27,631 per acre. The Maximum Special Tax for Undeveloped Property in Improvement Area A is $27,631 per acre. The Resolution of Intention proposes a Maximum Special Tax within Improvement Area B for Developed Property within the property depicted in the boundary map, which shall be the greater of (i) the amount derived by application of the Assigned Special Tax as set forth in the Rate and Method for Improvement Area B or (ii) the amount derived by application of the Backup Special Tax. For example, the Assigned Special Tax for a Single Family Property in Improvement Area B ranges from $1,680 per taxable unit with residential floor area of less than 1,200 square feet to $2,200 per taxable unit with a residential floor area of greater than 2,399 square feet. The Assigned Special Tax on Multifamily Residential Property and Non Residential Property in Improvement Area B is $32,519 per acre. The Maximum Special Tax for Undeveloped Property in Improvement Area B is $32,519 per acre. The Resolution of Intention proposes a Maximum Special Tax within Improvement Area C for Developed Property within the property depicted in the boundary map, which shall be the greater of (i) the amount derived by application of the Assigned Special Tax as set forth in the Rate and Method for Improvement Area C or (ii) the amount derived by application of the Backup Special Tax. For example, the Assigned Special Tax for a Single Family Property in Improvement Area C ranges from $1,720 per taxable unit with residential floor area of less than 1,200 square feet to $2,240 per taxable unit with a residential floor area of greater than 2,399 square feet. The Assigned Special Tax on Multifamily Residential Property and Non Residential Property in Improvement Area C is $30,388 per acre. The Maximum Special Tax for Undeveloped Property in Improvement Area C is $30,388 per acre. The Resolution of Intention proposes a Maximum Special Tax within Improvement Area D for Developed Property within the property depicted in the boundary map, which shall be the greater of (i) the amount derived by application of the Assigned Special Tax as set forth in the Rate and Method for Improvement Area D or (ii) the amount derived by application of the Backup Special Tax. For example, the Assigned Special Tax for a Single Family Property in Improvement Area D ranges from $2,350 per taxable unit with residential floor area of less than 2,200 square feet to $3,210 per taxable unit with a residential floor area of greater than 3,799 square feet. The Assigned Special Tax on Multifamily Residential Property and Non Residential Property in Improvement Area D is $21,764 per acre. The Maximum Special Tax for Undeveloped Property in Improvement Area D is $21,764 per acre. Within each Improvement Area, to satisfy the Special Tax Requirement, the Board shall first levy the Special Tax proportionately on each Parcel of Developed Property within such Improvement Area at up to 100% of the applicable Assigned Special Tax as needed. If additional moneys are needed to satisfy the Special Tax Requirement for such Improvement Area, the Special Tax shall be levied: second, proportionately on each parcel of Approved Property at up to 100% of the Maximum Special Tax for Approved Property; third, proportionately on each parcel of Undeveloped Property at up to 100% of the Maximum Special Tax for Undeveloped Property; fourth, increased in equal percentages from the Assigned Special Tax up to the Maximum Special Tax for each parcel of Developed Property whose Maximum Special Tax is derived by the application of the Backup Special Tax; and, fifth, proportionately on each parcel of Public Property and/or Property Owner's Association Property that is not Exempt Property, at up to 100% of the Maximum Special Tax. The Backup Special Tax is to be determined in accordance with the Rate and Method when the applicable final map is recorded. Special Taxes shall not be levied within an Improvement Area to satisfy the Special Tax Requirement of another Improvement Area. The Resolution of Intention proposes that for each year in which any Bonds for an Improvement Area are outstanding the Special Tax shall be levied on all Parcels subject to the Special Tax within such Improvement Area. If any delinquent Special Taxes remain uncollected prior to or after all Bonds for such Improvement Area are retired, the Special Tax for such Improvement Area may be levied to the extent necessary to reimburse CFD No. 2016-74 for uncollected Special Taxes associated with the levy of such Special Taxes, but the Special Tax shall not be levied after Fiscal Year 2060-61 with respect to Improvement Areas A through D. The foregoing is only a summary of the Resolution of Intention which is on file with the Secretary. PUBLIC HEARING NOTICE IS HEREBY GIVEN THAT A PUBLIC HEARING WILL BE HELD ON SEPTEMBER 7, 2016, AT THE HOUR OF 9:00 A.M., OR AS SOON THEREAFTER AS SUCH MATTER CAN BE HEARD, AT A REGULAR MEETING OF THE BOARD OF DIRECTORS TO BE HELD IN THE BOARD OF DIRECTORS MEETING ROOM LOCATED AT 2270 TRUMBLE ROAD, PERRIS, CALIFORNIA, AT WHICH TIME THE BOARD OF DIRECTORS WILL HEAR ALL EVIDENCE AND TESTIMONY BY ALL INTERESTED PERSONS, PROPERTY OWNERS, VOTERS AND TAXPAYERS FOR OR AGAINST (1) THE ESTABLISHMENT OF CFD NO. 2016-74 AND IMPROVEMENT AREAS A THROUGH D THEREIN, (2) THE EXTENT OF CFD NO. 2016-74 AND IMPROVEMENT AREAS A THROUGH D THEREIN, (3) THE LEVY OF A SPECIAL TAX FOR IMPROVEMENT AREAS A THROUGH D WITHIN CFD NO. 2016 74, (4) THE ACQUISITION AND CONSTRUCTION OF THE IMPROVEMENTS, (5) THE AUTHORIZATION OF BONDED INDEBTEDNESS FOR IMPROVEMENT AREAS A THROUGH D WITHIN CFD NO. 2016-74, AND (6) ANY OTHER MATTERS AS SET FORTH IN THE RESOLUTION OF INTENTION. ALL PERSONS INTERESTED, INCLUDING PROPERTY OWNERS, TAXPAYERS AND REGISTERED VOTERS, MAY APPEAR AT THE HEARING AND PRESENT EVIDENCE AND TESTIMONY ORALLY OR IN WRITING FOR OR AGAINST ITEMS (1) THROUGH (6) ABOVE. EACH INDIVIDUAL WISHING TO SPEAK WILL BE LIMITED TO A THREE MINUTE ORAL PRESENTATION. IF THE OWNERS OF ONE HALF (1/2) OR MORE OF THE AREA OF LAND WITHIN IMPROVEMENT AREAS A THROUGH D WITHIN CFD NO. 2016-74 AND NOT EXEMPT FROM THE SPECIAL TAX FILE WRITTEN PROTESTS AGAINST ANY OF ITEMS (1) THROUGH (6) ABOVE, AND PROTESTS ARE NOT WITHDRAWN SO AS TO REDUCE THE VALUE OF THE PROTESTS TO LESS THAN A MAJORITY, THE BOARD OF DIRECTORS SHALL ABANDON THAT PORTION OF THE PROCEEDINGS PERTAINING TO SUCH ITEM(S) AND NO FURTHER PROCEEDINGS WITH RESPECT TO SUCH ITEM(S) SHALL BE TAKEN FOR A PERIOD OF ONE YEAR FROM THE DATE OF THE DETERMINATION BY THE BOARD OF DIRECTORS. THE BOARD OF DIRECTORS MAY MODIFY THE PROCEEDINGS IF SUCH MAJORITY PROTESTS ARE ONLY AGAINST A SPECIFIED ISSUE. UNDER THE ACT, THE BOARD OF DIRECTORS MAY EITHER CONCLUDE THE PUBLIC HEARING ON SEPTEMBER 7, 2016 OR MAY CONTINUE THE PUBLIC HEARING TO A LATER DATE IF THE COMPLEXITY OF THE PROPOSED DISTRICT OR THE NEED FOR PUBLIC PARTICIPATION REQUIRES ADDITIONAL TIME. IF THE BOARD OF DIRECTORS DETERMINES TO SUBMIT THE QUESTIONS OF LEVYING SPECIAL TAXES AND AUTHORIZING BONDED INDEBTEDNESS FOR IMPROVEMENT AREAS A THROUGH D WITHIN CFD NO. 2016-74, ELECTIONS WILL BE HELD WITHIN IMPROVEMENT AREAS A THROUGH D OF CFD NO. 2016-74 TO APPROVE THE LEVY OF THE SPECIAL TAXES THEREIN AND THE AUTHORIZATION OF BONDED INDEBTEDNESS FOR IMPROVEMENT AREAS A THROUGH D WITHIN CFD NO. 2016-74. AT SUCH ELECTIONS, EACH LANDOWNER WITHIN IMPROVEMENT AREAS A THROUGH D WITHIN CFD NO. 2016-74 SHALL BE ENTITLED TO CAST ONE VOTE FOR EACH ACRE OR PORTION THEREOF OWNED WITHIN EACH IMPROVEMENT AREA WITHIN CFD NO. 2016-74. FOR THE PROPOSITIONS TO BE ADOPTED, TWO THIRDS OF THE VOTES CAST ON EACH PROPOSITION AT THE ELECTION MUST FAVOR PASSAGE.
